I should probably fix the typo in my title, but.... eh.
Over 3,000 backers, and a $30/backer average.
I went with the physical stuff tier, so I guess that won't happen. I had forgotten that the game actually got released... I suppose I should check it out.

I should add, the comments are surprisingly positive. I think that's largely due to having delivered on the PC, at least.
I see at least one person asking for a refund (I'm not quite sure that person understands the situation, but...).

Yes, it failed after getting funded (which again, is rarer, but it does happen). It's pretty clear from the update that they were banking on money from the sales of the released game to help boost them along. And then the sales didn't happen.
These sorts of problems are why some backers on Kickstarter ask a lot of questions about whether what the game makers are proposing is actually feasible on the budget they've described. It's also an area where indie makers probably have the least experience. I'm sure there's always a "sacrifice yourself for the game" mentality, but at some point money runs out.
Some of the earliest games that I backed on Kickstarter still aren't out (Hyper Light Drifter, MN9, Shantae). I'm a bit more optimistic for some than others. . .

Didn't they file for bankruptcy though? I doubt they can/will pay it back. I know kickstarter has rules and guidelines in place for stuff like this, but I'm doubtful.
I feel bad for the people who donated and the devs who put their heart and soul into this project. The backers are surprisingly gracious about all of this, and that's refreshing at the very least.

While Kickstarter does not moderate or oversee projects, this contract leaves developers liable to litigation if they don't deliver. Additionally, I don't know if Kickstarter will drop support for certain individuals if they have a large enough dispute between the project lead and the donors, but in the name of public fairness (and their public image) I'd wager that to be likely. I also think what happened is that they tried to upgrade the game from 2.5D to 3D, and that burned their budget. They thought too big, and overspent, a similar fate that happened to Mighty No. 9, and led to Inafune-san starting a second Kickstarter for the same project. This is the screen that each developer sees when they start a funding campaign, so it goes to say that people who donated do have rights to get their funds back, and can indeed pursue a suit, if need be. Not saying it would be a clean process, but if enough people are upset about it, it can be done.

There have also been several successful lawsuits against KS projects that failed to deliver, so the legal precedent is there.

This all sounds like good news. Still not entirely clear about what's going to happen to the game itself.
Everything regarding the game sounds like a nice, solid "maybe" at this point. But it also looks like things can only get better from here.

In this case there's not very much chance of litigation against them.
Not only do they not have the money for it, but they actually DID deliver. They just didn't deliver something that was satisfying.
